Overview

This website is operated by Thirdmap / Third Map. Throughout the site, the terms “we”, “us” and “our” refer to Thirdmap / Third Map. By visiting our website, creating an account, purchasing a product, downloading a digital file, or using any of our services, you agree to be bound by these Terms of Service.

If you do not agree with these Terms, you should not use this website or purchase our products.

Digital Products

Thirdmap sells digital products, including high-resolution natural stone textures, 3D assets, material files and related digital content for use in 3D rendering, architectural visualization, design, illustration, animation, movies, games and other visual production workflows.

Our textures are digital representations of real natural stone slabs. They are not physical stone products.

Unless otherwise stated, our texture files are supplied in digital image formats such as JPG. Available resolutions may include 8K, 16K, 32K or other resolutions depending on the product. Some products may include additional maps, material settings or 3D files where specified on the product page.

Product Information

We make reasonable efforts to describe and present our products accurately. However, colours, contrast, scale and visual appearance may vary depending on your screen, software, render engine, colour management settings, lighting setup and workflow.

Natural stone has inherent variation. The digital texture you purchase represents the specific stone surface shown in the product images and previews.

Unless specifically stated otherwise, Thirdmap textures are not seamless or tileable. They are created from real natural stone slabs and are intended to preserve the natural character, veining and uniqueness of the source material.

Licence of Use

When you purchase or download a Thirdmap product, you receive a licence to use that digital product. You do not purchase ownership of the copyright, intellectual property or source material.

You may use Thirdmap products for personal and commercial projects, including but not limited to:

• 3D rendering
• architectural visualization
• interior design presentations
• product visualization
• animation
• illustration
• image manipulation
• film, advertising and game production
• client presentations and commercial artwork

You may use the products in final rendered images, videos, animations, presentations and other flattened or non-extractable creative works.

No royalties are owed to Thirdmap for commercial projects created using our products.

Restrictions

You may not:

• resell, share, transfer, sublicense or redistribute the original purchased files;
• upload the original files to any marketplace, asset library, stock website, file-sharing platform or public database;
• include the original files in a downloadable product where the files can be extracted or reused as standalone textures;
• sell or distribute modified versions of the textures as competing texture products;
• claim ownership or authorship of the original Thirdmap assets;
• use Thirdmap products to create a competing texture library, material library or digital asset database;
• use automated scraping, extraction, bots or similar systems to download or copy content from the website;
• use our products or website in a way that infringes copyright, intellectual property rights or applicable laws.

3D models, mesh files or scene files supplied by Thirdmap may not be redistributed, resold or made available to third parties unless we have given prior written permission.

Limited Redistribution Inside Other Works

You may use Thirdmap assets as part of your own finished creative work, provided the original texture files cannot be easily extracted, downloaded or reused as standalone assets.

For example, you may deliver rendered images, videos, animations or flattened presentation materials to your clients.

If you need to include Thirdmap texture files inside a 3D scene, game, application, tutorial, educational file, design software, configurator or downloadable model, you must ensure that the files are protected and not distributed as standalone high-resolution texture assets. If you are unsure whether your intended use is allowed, please contact us before distributing the project.

Artificial Intelligence and Machine Learning

Unless we give prior written permission, you may not use Thirdmap products, previews, images, texture files, 3D assets or website content to train, test, fine-tune or develop artificial intelligence systems, machine learning models, neural networks, generative models, texture-generation tools or similar technologies.

You may not use Thirdmap assets to create datasets intended to imitate, reproduce, replace or compete with Thirdmap products.

Accounts and Downloads

You may be required to create an account or provide customer information to purchase or access certain products.

You are responsible for keeping your login details secure. You must not share your account access with other people or allow unauthorised users to download products through your account.

Digital products are normally delivered by download link or customer account access after purchase. You are responsible for maintaining a suitable internet connection and suitable software to download, open and use the files.

We may suspend or restrict access to downloads or accounts where we reasonably believe there has been misuse, unauthorised sharing, fraudulent activity, payment issues or breach of these Terms.

Prices and Payments

All prices are listed in Australian dollars unless stated otherwise.

We may change prices, promotions, product availability or product descriptions at any time. Changes will not affect purchases that have already been completed.

Payments are processed through the payment methods available at checkout. By placing an order, you confirm that the payment information provided is accurate and that you are authorised to use the selected payment method.

Refunds and Digital Downloads

Because Thirdmap products are digital files that can be accessed or downloaded after purchase, all sales are generally final once the download has been made available.

We do not usually offer refunds for change of mind, accidental purchases, selecting the wrong resolution, software incompatibility, or if the product is no longer needed after purchase.

However, if there is a technical issue with your download, a missing file, a corrupted file, or if the product is significantly different from its description, please contact us and we will review the issue. Where appropriate, we may provide a replacement file, technical support, store credit or a refund.

Nothing in these Terms limits or excludes your rights under Australian Consumer Law or any other applicable consumer protection laws.

Australian Consumer Law

Our products and services may come with guarantees that cannot be excluded under Australian Consumer Law. If a product or service fails to meet a consumer guarantee, you may be entitled to a remedy depending on the circumstances.

Where a major problem exists, consumers may be entitled to choose a refund or replacement. For minor problems, the business may be entitled to fix the issue first.

These Terms are intended to apply only to the maximum extent permitted by law.

Intellectual Property

All content on this website, including textures, images, previews, product files, 3D assets, logos, branding, text, graphics, layouts and digital materials, is owned by Thirdmap / Third Map or licensed to us.

Nothing in these Terms transfers ownership of our intellectual property to you. Your purchase grants you a licence to use the product according to these Terms.

Website Content

You may not copy, reproduce, distribute, modify, scrape, mirror, republish or commercially exploit any part of this website without our prior written permission.

You may share links to our website or product pages in a fair and reasonable way, provided this does not misrepresent your relationship with Thirdmap or imply endorsement without permission.

User Content and Gallery Submissions

If you submit images, renders, testimonials or other content to Thirdmap, you confirm that you have the rights to share that content with us.

By submitting content, you grant Thirdmap permission to display, reproduce and share that content for promotional, portfolio, gallery, social media and marketing purposes, unless otherwise agreed in writing.

You retain ownership of your own submitted artwork.

Third-Party Tools and Links

Our website may use third-party services for payments, analytics, email, hosting, downloads, apps or other functions. We are not responsible for third-party websites or services that are outside our control.

Links to third-party websites are provided for convenience only and do not imply endorsement.

Limitation of Liability

To the maximum extent permitted by law, Thirdmap is not liable for indirect, incidental, special or consequential losses, including loss of profits, loss of revenue, loss of data, business interruption or project delays arising from the use or inability to use our products or website.

Where liability cannot be excluded, our liability is limited to the amount paid by you for the relevant product or service, unless otherwise required by law.

Prohibited Use

You must not use our website or products:

• for unlawful purposes;
• to infringe intellectual property rights;
• to distribute viruses, malware or harmful code;
• to interfere with the security or operation of the website;
• to abuse, harass or threaten Thirdmap, its customers or any third party;
• to attempt unauthorised access to our systems, files, accounts or services.

Termination

We may suspend or terminate access to your account, downloads or services if we reasonably believe that you have breached these Terms, misused our products, engaged in fraud, shared files without permission, or used the website in an unlawful or harmful way.

Termination does not remove any restrictions on redistribution, intellectual property, confidentiality, AI use or other obligations that are intended to continue after access ends.

Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page. Your continued use of the website or our products after changes are posted means that you accept the updated Terms.

Governing Law

These Terms are governed by the laws of Queensland, Australia, and applicable federal laws of Australia.

Any dispute relating to these Terms, the website or our products will be subject to the jurisdiction of the courts of Queensland, Australia, unless otherwise required by law.
