General Rules

1. Acceptance and Scope

These General Rules govern access to and use of the Thirdmap / Third Map website, accounts, downloads and related services (the “Service”).

Please read these General Rules together with our Texture & Asset Licence, Terms of Service and Privacy Policy. These documents explain the conditions applicable to the Service and to the digital products you purchase or download.

By accepting these terms when registering, purchasing, downloading or otherwise using the Service, you agree to the applicable conditions presented to you. If you do not agree, you must not proceed with the relevant transaction or use.

If you act on behalf of a company or another legal entity, you confirm that you have authority to accept these conditions for that entity. The licence holder is the person or entity identified in the transaction. Affiliates, customers and other third parties do not automatically receive independent rights to use the Assets.

2. Accounts and Registration

Certain purchases, downloads or services may require an account or customer information.

You must provide accurate, current and complete information and keep it reasonably up to date.

You are responsible for keeping your account credentials confidential and taking reasonable steps to prevent unauthorised access. Do not share your password or allow another person to download products through your account.

If you become aware of unauthorised access or suspected misuse, notify us promptly at info@thirdmap.au.

We may request correction of inaccurate information or reasonably restrict access where necessary to address fraud, security risks or a material breach. Account suspension and termination are subject to section 12 below.

You may request closure of your account. Closing an account does not, by itself, terminate a valid licence for previously acquired Assets.

3. The Service and Digital Assets

The Service provides access to high-resolution textures, image maps, material settings, 3D assets and related digital files (“Assets”).

Assets are digital products. Purchasing or downloading them grants only the rights specified in the applicable licence; it does not transfer ownership of the Assets or their intellectual property.

Product pages describe the files, resolutions and other features included in each purchase. Unless expressly stated, additional maps, editable source files, seamless versions, updates or technical services are not included.

We may add or remove products from the catalogue. Removing a product does not, by itself, revoke a licence already validly granted.

4. Permitted Creative Uses

The Texture & Asset Licence defines the permitted uses of the Assets.

Subject to the applicable licence category, these uses include 3D rendering, architectural and product visualisation, interior design presentations, illustration, advertising, animation, film and game production.

You may sell or deliver permitted finished creative works in accordance with that licence. Printing finished renders and presentations in portfolios, project documents, brochures and advertising is permitted.

This permission does not authorise reproducing a texture as the decorative design, finish or surface of a physical product.

A Personal licence permits personal, non-commercial projects only. A Commercial licence permits the commercial creative uses specified in the Asset licence. Where no category is specified, the Asset licence explains the applicable permissions.

Neither a Personal nor a Commercial standard licence includes industrial printing, manufacturing or physical surface reproduction rights.

References to “commercial use” or “royalty-free” apply only to expressly permitted uses. They do not grant unrestricted exploitation rights.

5. Industrial Printing, Manufacturing and Physical Products

A separate written licence from Thirdmap is required before using an Asset, in whole or in part, as the pattern, decoration, finish or surface design of a physical product, material or architectural surface.

This includes reproduction by printing, transfer, coating, engraving, embossing, manufacturing or any other process for sale, supply, distribution, installation, commercial use or use on behalf of a customer.

Examples include:

• ceramic and porcelain tiles;

• slabs and engineered stone;

• laminates and decorative panels;

• wallpaper and wall or floor coverings;

• glass and textiles;

• furniture and countertops;

• packaging and merchandise;

• decorative prints where the Asset supplies the principal decorative image.

The restriction includes bespoke projects, one-off commissions, print-on-demand, mass production, manufacturing prototypes, sample surfaces, production trials and print tests for these purposes.

It applies to original and modified Assets, including cropped, recoloured, retouched, composited, tiled, mirrored, vectorised or upscaled versions. Reproducing the design from a render, screenshot, flattened image or other intermediate work does not avoid the restriction.

You must not commission, authorise, sublicense or knowingly supply files to another person for these restricted uses without the required written licence.

There is no minimum production quantity or revenue threshold that creates an exception.

For industrial licensing enquiries, contact info@thirdmap.au. Any permission must be expressly agreed in writing and is limited to the Assets, uses, parties, territory, duration and other conditions specified in that agreement.

Receiving a quotation, portfolio or evaluation sample does not grant production rights.

6. No Resale or Unauthorised Redistribution

You must not sell, share, give away, rent, transfer, sublicense, publish or redistribute Assets as standalone files, asset packs, stock content, material libraries or competing products, whether original or modified.

These restrictions apply to paid and free distribution at every resolution. There is no general exception for 1K files, JPEG files, low-resolution textures or material settings.

Permitted delivery of finished works and permitted embedding in compiled games or applications are governed exclusively by the Texture & Asset Licence.

Including Assets in downloadable models, editable scenes, templates, tutorials, material libraries, design tools or configurators requires prior written permission as specified in that licence. Technical protection alone does not authorise those uses.

You must not use the Assets to create a competing texture library or provide third parties with access to reusable texture files.

Customers receiving your finished work do not acquire independent rights to extract, redistribute, sublicense or reproduce the underlying Assets as physical surface designs.

7. Storage and Authorised Personnel

You may maintain working copies and backups on secure local drives or private network storage.

Do not store Assets in publicly accessible locations or shared libraries accessible by unlicensed third parties.

Employees and contractors may access Assets only as reasonably necessary to work on the licence holder’s permitted projects, under confidentiality and use restrictions consistent with the Texture & Asset Licence.

They receive no independent reuse rights and must delete working copies when their involvement ends. You remain responsible for access you authorise.

Access by a printer, manufacturer or other contractor for a restricted physical reproduction use requires the separate written licence described above.

8. Fees, Payments and Downloads

Prices and payment conditions are displayed on the website or agreed in writing before purchase.

Payment authorisation applies to the transaction you approve. Creating an account does not itself authorise recurring charges or future purchases.

Recurring payments, subscriptions or prepaid download credits apply only where expressly offered and accepted under clearly disclosed additional conditions. These General Rules do not create a subscription or download-credit arrangement.

Price changes do not alter completed purchases.

Downloads are normally provided through a download link or customer account. Maintain suitable backups of files you have lawfully downloaded. Any stated download limits or access periods must be disclosed before purchase.

If payment fails or is reversed, we may contact you and reasonably restrict access to the affected unpaid order while the issue is resolved. Any resulting licence termination is governed by the Texture & Asset Licence.

Refunds and remedies are governed by the Terms of Service, the applicable refund policy and mandatory law. Nothing in these General Rules makes an otherwise available statutory remedy non-refundable.

9. Internet Access and Technical Requirements

You are responsible for obtaining a suitable internet connection, storage capacity and compatible software.

Review the stated file formats and technical specifications before purchasing.

Service availability may be affected by maintenance, network interruptions or circumstances outside our reasonable control. We do not promise uninterrupted access, but this does not exclude obligations or remedies imposed by applicable law.

10. Artificial Intelligence and Machine Learning

Without Thirdmap’s prior written permission, you must not use Assets or website images to train, test, fine-tune or develop artificial intelligence systems, machine-learning models or related datasets.

You must not use them to develop tools that imitate, reproduce or replace Thirdmap Assets.

Uploading Assets to a service that acquires rights to train on or redistribute them is prohibited.

The detailed AI restrictions in the Texture & Asset Licence apply.

11. Website Security, Automated Access and APIs

You must not:

• attempt unauthorised access to accounts, files, systems or restricted areas;

• bypass authentication, download controls or security measures;

• scrape, systematically extract, mirror or copy the catalogue;

• introduce malicious code or interfere with the Service;

• impose an unreasonable load on our systems;

• reverse engineer or interfere with website software except where applicable law permits;

• use the Service unlawfully or infringe another person’s rights.

Access to a Thirdmap API requires prior written authorisation unless Thirdmap expressly publishes terms permitting that access. Any authorised use must remain within its agreed scope and limits.

These website-security restrictions do not prevent ordinary editing of lawfully acquired Assets for uses expressly permitted by the Texture & Asset Licence.

12. Suspension, Breach and Termination

We may reasonably suspend or restrict account or download access while investigating suspected fraud, unauthorised sharing, security threats or material breach. We will provide notice and an opportunity to resolve the issue where practicable.

Termination of an Asset licence, including notice, remedy periods and consequences, is governed by the Texture & Asset Licence. These General Rules do not create a separate termination procedure that overrides it.

Account closure, removal of a product or a later price change does not itself terminate an existing valid Asset licence.

Unauthorised manufacturing, distribution or other infringement may entitle Thirdmap to seek remedies available under applicable law. These General Rules do not impose an automatic penalty or unrestricted obligation to compensate Thirdmap for every loss.

13. Intellectual Property

Thirdmap or its licensors retain intellectual property rights in the Assets, website content, branding, software and related materials.

You must not claim ownership or authorship of the original Assets.

You retain rights in your original contributions to permitted finished works, subject to the rights in incorporated Assets.

A licence to a digital representation of natural stone does not grant exclusive rights over the natural stone itself, its name or independently created representations of it.

Where a project involves third-party trademarks, protected designs or other rights outside the Asset licence, you are responsible for obtaining any additional permissions required for your intended use.

14. Confidentiality

You must take reasonable steps to protect non-public information expressly identified as confidential or reasonably understood to be confidential, including private access credentials, unpublished files and confidential commercial proposals.

This obligation does not prevent permitted use of Assets, disclosure to authorised personnel, disclosure required by law, or disclosure to professional advisers under appropriate confidentiality obligations.

It does not apply to information that is lawfully public, independently developed or lawfully obtained without a confidentiality restriction.

Confidential information must remain protected for as long as it remains confidential. Asset redistribution restrictions continue for the duration specified in the applicable licence.

15. Privacy and Technical Information

We handle personal information in accordance with our Privacy Policy.

Information reasonably required for payments, order delivery, account administration, security and support may be processed by service providers as described in that policy.

These General Rules do not grant unrestricted rights to collect, disclose or commercially exploit your personal information.

16. Communications and Conduct

We may send electronic communications reasonably necessary to administer purchases, licences, accounts, security matters and support requests.

Marketing communications are handled separately in accordance with applicable law and available unsubscribe options.

You must not threaten, harass or abuse Thirdmap personnel or use the Service to harm others. We may take proportionate steps to protect personnel and systems.

Good-faith complaints, lawful criticism and the exercise of legal rights are not prohibited.

17. Feedback and Submitted Work

You are not required to provide feedback or suggestions.

If you voluntarily provide general product feedback, you permit Thirdmap to use it to improve the Service without an obligation to pay compensation. This does not transfer ownership of your artwork, confidential project information or other intellectual property.

Artwork and gallery submissions are governed by the User Content and Gallery Submissions provisions in the Terms of Service.

18. Warranties, Liability and Consumer Rights

The warranties, liability provisions and consumer protections in the Terms of Service apply.

Nothing in these General Rules excludes, restricts or modifies a consumer guarantee, remedy or other right that cannot lawfully be excluded, including under Australian Consumer Law.

These General Rules do not require you to waive legitimate claims, accept liability for Thirdmap’s own wrongdoing or give Thirdmap control over a claim you bring against it.

19. Applicable Version and Changes

The terms and Asset licence disclosed and accepted when an Asset is purchased or downloaded govern that acquisition.

We may publish revised conditions for future transactions. Revised conditions do not retrospectively remove previously granted rights or amend a separately agreed written licence.

A later purchase or download does not automatically replace the licence for previously acquired Assets. Continued use of previously acquired Assets does not, by itself, constitute acceptance of a replacement licence.

Materially adverse changes to ongoing website services will be notified with reasonable advance notice where practicable.

20. Relationship Between Documents

These General Rules supplement the Texture & Asset Licence and Terms of Service.

For transactions subject to this version:

• the Texture & Asset Licence governs permitted Asset use, redistribution, industrial rights, authorised personnel, AI restrictions, licence duration and licence termination;

• the Terms of Service govern transactions, website operation, refunds, liability and general service conditions;

• these General Rules provide supporting account, security and operational conditions.

If an inconsistency arises, the Texture & Asset Licence prevails on Asset licensing matters and the Terms of Service prevail on transaction and service matters.

A separately negotiated written agreement prevails only within its expressly agreed scope.

General descriptions such as “commercial”, “royalty-free” or “high resolution” do not expand the rights expressly granted.

This version replaces the previous General Rules/EULA for new transactions from its publication. Earlier acquisitions remain governed by their applicable agreements.

21. Disputes and Governing Law

Please contact info@thirdmap.au so that we can attempt to resolve a concern in good faith.

Nothing requires you to submit to compulsory private arbitration or prevents either party from seeking urgent relief, using an available tribunal or exercising a statutory right.

These General Rules are governed by the laws of Queensland, Australia, and applicable federal laws. The jurisdiction provisions in the Terms of Service apply, subject to mandatory law.

No shortened contractual deadline for bringing a claim is imposed by these General Rules.

22. General Provisions

Failure to enforce a provision on one occasion does not waive the right to enforce it later.

If a provision is invalid or unenforceable, the remaining provisions continue to apply to the extent they can operate lawfully.

You may not transfer your Asset licence except as permitted by the applicable licence or agreed in writing.

Thirdmap may transfer its contractual position as part of a genuine business transfer, provided this does not reduce your existing licence rights or mandatory protections. We will provide notice where the transfer materially affects you.

Nothing creates a partnership, employment relationship, agency or authority for either party to bind the other.

The applicable documents identified above, together with any expressly agreed written licence, form the agreement concerning their subject matter. Nothing excludes rights arising from statements or representations that applicable law requires us to honour.
